1. About the Platform

Avysh Technologies Private Limited (“Avysh”, “we”, “us”, or “our”) operates Avysh ONDC Store (“Platform”), a technology-based marketplace that acts as a Buyer Application (BAP) on the Open Network for Digital Commerce (ONDC).

Avysh is a facilitator, not a seller. Products listed on the Platform are offered by independent sellers (Seller Application Providers, or SNPs) registered on the ONDC network. Avysh does not manufacture, stock, or ship any products. The contract of sale is directly between you (the buyer) and the relevant seller.

By accessing or using the Platform, you agree to these Terms and Conditions (“Terms”). If you do not agree, please do not use the Platform.

2. Eligibility

• You must be at least 18 years of age to use the Platform.
• You must be legally competent to enter into a binding contract under the Indian Contract Act, 1872.
• Use of the Platform is void where prohibited by applicable law.
• By using the Platform, you represent and warrant that you meet these requirements.

3. Account Registration

To access certain features (placing orders, tracking, etc.), you must create an account. You may register using your email address or via Google Sign-In.

• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate, current, and complete information during registration.
• You must notify us immediately of any unauthorised access to your account at info@avysh.com.
• We reserve the right to suspend or terminate accounts that violate these Terms.
• One person may only maintain one active account on the Platform.

4. Products, Listings & Pricing

• Prices displayed include applicable taxes unless stated otherwise.
• Prices may vary by delivery location due to ONDC network routing to different sellers.
• Avysh reserves the right to remove listings that violate platform policies or applicable laws.
• Product images are illustrative. Actual products may vary; refer to the seller's textual description.
• We currently support the Electronics & Appliances category. Additional categories may be added over time.

5. Placing an Order

The ONDC order flow is asynchronous and operates in multiple steps:

An order is confirmed only after Razorpay payment is successfully processed and the seller sends an order confirmation via the ONDC network. We will notify you by email upon successful order placement.

6. Payments

All payments on the Platform are processed by PCI-DSS compliant payment gateway partners. Avysh does not store card numbers, UPI credentials, or bank account details.

• Accepted payment methods: UPI, Net Banking, Credit/Debit Cards, and supported wallets (varies by gateway).
• Prices are in Indian Rupees (INR) and include applicable GST.
• Payment must be completed at the time of order. Orders are not held without payment.
• For Cash on Delivery (CoD), availability depends on the seller and delivery location.
• Failed transactions are not charged; any temporary holds are released within 5–7 business days by your bank.

7. Cancellations, Returns & Refunds

Cancellations and returns are subject to the seller's policies as communicated at the time of order. Avysh facilitates but does not guarantee cancellation or return acceptance.

• Cancellations: Request via your account's order history. Acceptance is at the seller's discretion.
• Returns: Eligible within the seller's stated return window. Item must be unused and in original packaging.
• Refunds: Initiated within 48 hours of return pickup confirmation. Timelines depend on payment method.

8. Prohibited Activities

You agree not to:

• Use the Platform for any unlawful purpose or in violation of applicable Indian laws
• Attempt to gain unauthorised access to the Platform, servers, or other accounts
• Submit false, misleading, or fraudulent information (including delivery addresses)
• Place orders with no intention to pay or accept delivery
• Use automated bots, scrapers, or crawlers to access the Platform without permission
• Reproduce, distribute, or commercially exploit any content on the Platform without our written consent
• Circumvent or interfere with the security features of the Platform
• Engage in conduct that could damage, disable, or impair the ONDC network or our services

9. Intellectual Property

All content on the Platform — including the Avysh name, logo, design, software, text, and graphics — is the property of Avysh Technologies Private Limited or its licensors and is protected by applicable intellectual property laws.

Product names, descriptions, and images are the property of their respective sellers or manufacturers. Avysh grants you a limited, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial purposes only.

10. Third-Party Services

The Platform integrates with third-party services. Your use of these services is governed by their respective terms and policies:

• ONDC Network: An open commerce protocol governed by the Open Network for Digital Commerce (a Section 8 company under DPIIT, Government of India).
• Payment Gateway Partners: Payment processing. Each gateway's Terms of Service and Privacy Policy govern their use of your payment data.
• Google Sign-In: Authentication. Subject to Google's Terms of Service and Privacy Policy. We use OAuth 2.0 for secure authentication only.
• Meilisearch: Product search indexing for fast and relevant product discovery.

Avysh is not responsible for the availability, accuracy, or practices of third-party services.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• Avysh is not liable for the quality, safety, legality, or fitness of products sold by sellers on the ONDC network.
• Avysh is not liable for delays, failures, or errors in the ONDC network communication between buyers and sellers.
• Avysh's total aggregate liability to you for any cause of action shall not exceed the amount paid by you for the order giving rise to the claim.
• Avysh is not liable for indirect, incidental, special, or consequential damages arising from use of the Platform.
• Nothing in these Terms excludes liability that cannot be excluded under applicable Indian consumer protection laws.

12. Disclaimer of Warranties

The Platform is provided on an “as is” and “as available” basis. Avysh makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted availability. We do not warrant that the Platform will be error-free or that defects will be corrected.

13. Grievance & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any disputes not resolved through the above process shall be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka, India.

14. Governing Law

These Terms are governed by Indian law, including but not limited to:

• Information Technology Act, 2000 and IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021
• Consumer Protection Act, 2019 and Consumer Protection (E-Commerce) Rules, 2020
• Indian Contract Act, 1872
• Goods and Services Tax (GST) laws
• ONDC Network Policy and Participant Agreements

15. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform at least 7 days before they take effect.

Continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms. The current version is always available at this URL.
